MarketingBy.AI is the marketing website for Marketing By AI, a company that builds AI voice agents for Professional firms. These Terms govern your use of the website. If you become a paying customer, a separate Service Agreement governs that relationship.

1. Acceptance of Terms

By accessing or using MarketingBy.AI (the "Site"), you agree to these Terms of Use ("Terms"). If you do not agree, do not use the Site.

These Terms are a contract between you and Marketing By AI ("we," "us," "Marketing By AI"), a California limited liability company (EIN 99-3491100), doing business at MarketingBy.AI.

2. What These Terms Cover

These Terms govern your use of the Site itself: browsing, reading, submitting a demo request, and contacting us.

These Terms do not govern the customer-facing SaaS service (which is governed by a separate Service Agreement) or any third-party website linked from the Site.

If there is any conflict between these Terms and a signed Service Agreement, the Service Agreement controls.

3. Eligibility

You must be at least 18 years old to use the Site.

4. Permitted Use

You may use the Site to read information about Marketing By AI, request a free demo, contact us, sign up for the service, and share links to public pages.

5. Prohibited Use

You may not: violate any law; impersonate any person; submit false information; attempt unauthorized access to the Site or its systems; use automated means (bots, scrapers) to collect data except for search engine indexing; interfere with the Site's operation; reverse engineer any software; or use Site content for commercial purposes without our written permission.

6. Intellectual Property

All content on the Site — text, graphics, logos, images, software, and design — is owned by Marketing By AI or our licensors and protected by copyright, trademark, and other intellectual property laws. You may view and download content for personal, non-commercial use only.

"Marketing By AI," "MarketingBy.AI," and "Marissa" are trademarks of Marketing By AI .

7. Demo Requests

When you submit a demo request, you agree that the information you provide is accurate, that you consent to receiving communications about your request, and that you may opt out of marketing communications at any time. See our Privacy Policy for details.

8. SMS/Text Message Terms

By opting in to receive SMS text messages from Marketing By AI, you agree to the following:

  • Marketing By AI may send you SMS notifications related to your interactions with our services, including demo requests, lead activity alerts, and service notifications.
  • Message frequency varies. Estimated frequency is 5-20 messages per month.
  • Message and data rates may apply. Check with your carrier for details.
  • You may opt out at any time by replying STOP to any message. After opting out, you will receive one confirmation message and no further messages will be sent.
  • For help, reply HELP to any message or email [email protected].
  • No mobile information will be shared with or sold to third parties or lead generators for marketing or promotional purposes. See our Privacy Policy Section 9 for full details.
  • SMS messages are supported on all major US carriers. Carriers are not liable for delayed or undelivered messages.
  • By providing your mobile number and opting in, you confirm that you are the owner or authorized user of the mobile device and number provided, and that you consent to receive SMS messages from Marketing By AI at the number provided.

9. AI Disclosure

The Site discusses Marissa, an AI voice agent we build and deploy for Professional firm customers. When you interact with Marissa in any context (on the Site, on a Professional firm's website, or on a Professional firm's phone line), Marissa will identify herself as an AI agent if you ask. We comply with applicable AI disclosure laws in California and elsewhere.

The Site may contain links to third-party websites. We do not endorse or take responsibility for any third-party site.

11. Disclaimer of Warranties

THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY CALIFORNIA LAW, MARKETING BY AI DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

MARISSA DOES NOT PROVIDE TAX, LEGAL, ACCOUNTING, FINANCIAL, OR INVESTMENT ADVICE. The Professional firm — not Marketing By AI — is responsible for any professional advice provided to clients.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY CALIFORNIA LAW, MARKETING BY AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIMS RELATED TO THESE TERMS SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100.00).

These limitations do not apply to liability that cannot be limited under California law, including per Cal. Civ. Code Section 1668.

13. Indemnification

You agree to indemnify and hold harmless Marketing By AI from any claims arising out of your use of the Site, your violation of these Terms, or your violation of any law or third-party rights.

14. Governing Law

These Terms are governed by California law. Any dispute shall be brought exclusively in the state or federal courts located in [your county], California. Before filing any legal action, you agree to attempt informal resolution for at least 30 days.

15. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last Updated" date and post the updated Terms at MarketingBy.AI/terms.
