In Plain Language

Marketing By AI is a California company that builds AI voice agents for Professional firms. Our voice agent is named Marissa. We collect two kinds of information:

  1. Information about visitors to MarketingBy.AI — page views, demo requests, things you type into a form, basic device data. We use this to operate the website and respond to your inquiries.
  2. Information collected by Marissa when she answers calls on behalf of our Professional firm customers — caller name, callback phone number, call recordings, and conversation transcripts. We collect this on behalf of the Professional firm, not for ourselves.

We do not sell your personal information. We do not share it with advertisers. We do not share or sell mobile information to third parties for any purpose.

1. Who We Are

This Privacy Policy is published by Marketing By AI , a California limited liability company (EIN 99-3491100), doing business at MarketingBy.AI. We are headquartered in California and operate primarily in the United States.

Throughout this policy, "we," "us," and "Marketing By AI" refer to the company. "You" refers to anyone whose personal information we process, whether you are visiting our website, requesting a demo, or interacting with our voice agent on a Professional firm's website or phone line.


2. Scope of This Policy

This Privacy Policy applies to:

  • The website at MarketingBy.AI and all subdomains (including voice.marketingby.ai)
  • Our marketing emails
  • Our SMS/text message notifications
  • The Marissa voice agent when deployed on a Professional firm client's website or phone line
  • Any other digital touchpoint we operate

This Privacy Policy does not apply to:

  • The Professional firm's own website (the firm has its own privacy policy)
  • Third-party websites linked from MarketingBy.AI
  • Any service or product not operated by Marketing By AI

3. Our Two Roles

Marketing By AI processes personal information in two distinct roles.

Role 1 — Business: Information Collected Directly from You on MarketingBy.AI

When you visit MarketingBy.AI, request a demo, sign up for a service, or contact us, we are the Business that collects and uses your information. This Privacy Policy describes our practices for that information.

Role 2 — Service Provider: Information Collected by Marissa on a Professional Firm's Behalf

When Marissa is deployed at a Professional firm and answers a call from one of the firm's clients (or potential clients), we act as a Service Provider to that Professional firm. The Professional firm is the Business that owns the relationship with the caller. We process the caller's information on the firm's behalf, only for the limited and specified purposes of operating the agent.

If you are a caller who interacted with Marissa on a Professional firm's phone line or website, your privacy rights are primarily governed by the Professional firm's own privacy policy. We will assist the Professional firm in responding to your requests, but the firm is the primary party responsible for your data.


4. Information We Collect

4.1 Information Collected About You on MarketingBy.AI

When you visit our website, sign up for a demo, or contact us, we may collect the following categories of personal information:

4.2 Information Collected by Marissa on a Professional Firm's Behalf

When Marissa is deployed at a Professional firm client and you interact with her, we collect (as a Service Provider on the firm's behalf):

We do not ask for, and Marissa is configured to refuse to collect:

  • Social Security numbers
  • Dates of birth
  • Financial account numbers
  • Government-issued identification numbers
  • Credit card or payment information
  • Protected health information

4.3 Information Collected Automatically

When you visit MarketingBy.AI, we automatically collect certain information using cookies and similar technologies:

  • IP address
  • Browser type and version
  • Device type and operating system
  • Pages viewed and time spent
  • Referring URL

We use a privacy-respecting analytics provider and do not use Google Analytics or any tracking technology that profiles you across other websites.


5. How We Use Information

5.1 Information Collected on MarketingBy.AI

We use information collected directly from you to:

  • Respond to demo requests and other inquiries
  • Configure and deliver the service if you become a customer
  • Send service-related communications
  • Send internal business notifications via SMS to our team (see Section 9)
  • Improve the website and our services
  • Comply with legal obligations
  • Detect and prevent fraud and security incidents

We do not use your information to:

  • Sell or rent it to anyone
  • Build a profile of you across other websites
  • Target you with behavioral advertising
  • Train AI models shared with parties outside Marketing By AI

5.2 Information Collected by Marissa on a Professional Firm's Behalf

When Marissa collects information on behalf of a Professional firm client, we process that information solely for the limited purpose of operating the voice agent. We do not use caller information for any other purpose. We do not use it to market to the caller. We do not combine it with information from other Professional firms. We do not sell it.


6. How We Share Information

We share personal information only in the following limited circumstances:

6.1 With Your Professional Firm

If you interact with Marissa on a Professional firm's website or phone line, we share the captured caller information (name, callback number, conversation summary, transcript) with that Professional firm.

6.2 With Third-Party Infrastructure Providers

We use third-party infrastructure providers to deliver the service. These providers include AI model providers, voice synthesis providers, telephony providers, and hosted application platforms. Each provider is bound by contractual obligations to process personal information only as instructed by us, implement reasonable security measures, and not use the information for their own purposes.

We may disclose personal information when required by law, valid legal process, or to protect the rights, property, or safety of Marketing By AI, our customers, or others.

6.4 In Connection with a Business Transfer

If Marketing By AI is acquired, merged, or sells substantially all of its assets, personal information may be transferred to the acquiring entity. We will provide notice to affected individuals and the opportunity to delete information before the transfer where required.

We may share information for any other purpose with your explicit consent.

We do not sell personal information as defined under the California Consumer Privacy Act (CCPA/CPRA), and we do not "share" personal information for cross-context behavioral advertising as defined under the California Privacy Rights Act.

8. Your Privacy Rights

8.1 Rights for California Residents (CCPA/CPRA)

If you are a California resident, you have the following rights regarding your personal information that we collect as a Business:

  • Right to Know — request what categories of personal information we collect, the sources, the purposes, and with whom we share it
  • Right to Access — request a copy of the specific personal information we have about you
  • Right to Delete — request deletion of personal information we have collected from you
  • Right to Correct — request correction of inaccurate personal information
  • Right to Opt Out of Sale or Sharing — we do not sell or share personal information, so this right is automatically honored
  • Right to Limit Use of Sensitive Personal Information — direct us to limit our use of sensitive personal information
  • Right to Non-Discrimination — you will not be denied service or charged differently for exercising these rights

8.2 Rights for Callers (Marissa Interactions)

If your information was collected by Marissa during a call to one of our Professional firm clients, your privacy rights are primarily honored by the Professional firm. You may also contact us at [email protected] and we will assist the firm in responding to your request.

8.3 How to Exercise Your Rights

Email [email protected] with your request. Include your name, contact information, and a description of the right you wish to exercise. We will respond within 45 days.


9. SMS/Text Messaging Policy

This section applies to SMS/text messages sent by Marketing By AI.

9.1 What SMS Messages We Send

Marketing By AI uses SMS text messaging for internal business notification purposes only. We send automated alerts to our business team when prospective customers interact with our AI voice agent demos or respond to business communications. These notifications contain the prospect's name, company name, and a brief description of the interaction.

9.2 No Mobile Information Shared with Third Parties

No mobile information collected by Marketing By AI, including phone numbers, SMS content, or any data obtained through our SMS messaging program, will be shared with or sold to third parties or lead generators for marketing, promotional, or any other purposes. This prohibition applies at all times, without exception.

We do not sell, rent, loan, trade, lease, or otherwise transfer for profit any phone numbers or personal information collected through our SMS programs to any third party.

All recipients of SMS messages from Marketing By AI have provided prior express consent to receive such messages. For our internal business notifications, the business owner (Jeff Newton) configured the notification system and designated his own mobile number as the notification recipient.

9.4 Message Frequency

Message frequency varies based on business activity. Estimated frequency is 5-20 messages per month. Message and data rates may apply.

9.5 Opting Out

You may opt out of SMS messages at any time by replying STOP to any message. After opting out, you will receive one confirmation message and no further messages will be sent.

9.6 Supported Carriers

Marketing By AI SMS messages are supported on all major US carriers including AT&T, Verizon, T-Mobile, Sprint, and others. Carriers are not liable for delayed or undelivered messages.


10. CCPA/CPRA Service Provider Designation

When Marketing By AI processes personal information on behalf of a Professional firm client (Role 2 as described in Section 3), we act as a Service Provider as defined under the California Consumer Privacy Act (Cal. Civ. Code Section 1798.140) and the California Privacy Rights Act. Marketing By AI shall:

  • Process personal information only for the limited and specified purposes described in the applicable service agreement
  • Not sell or share personal information
  • Not retain, use, or disclose personal information for any purpose other than performing the service
  • Comply with the obligations applicable to Service Providers under CCPA/CPRA
  • Promptly notify the Professional firm if we determine we can no longer meet our obligations
  • Permit the Professional firm to take reasonable steps to stop and remediate any unauthorized use

11. AI Disclosure

Marissa is an AI voice agent. We disclose this for transparency and compliance with applicable AI disclosure laws.

  • Marissa is AI, not a human. When asked "are you a real person" or "are you AI," Marissa discloses that she is an AI agent.
  • Marissa is grounded on a defined knowledge base — the Professional firm's own website plus a curated tax procedural knowledge base. She does not generate answers from the open internet.
  • Marissa does not give tax, legal, accounting, or financial advice. Any question requiring professional judgment is routed to a human at the firm.
  • Marissa captures caller name and callback phone number at the start of every call, framed as a protective measure in case the call drops.
  • Marissa records and transcribes conversations for the purposes described in this policy.

12. Security

We use commercially reasonable administrative, technical, and physical safeguards to protect personal information, including encryption of data in transit and at rest, access controls, and contractual security obligations on third-party providers. No method of transmission or storage is 100% secure, but we work to protect your information consistent with industry standards.


13. Children's Privacy

MarketingBy.AI is not directed to children under 13 and we do not knowingly collect personal information from children under 13. If you believe we have collected information from a child under 13, contact us at [email protected] and we will delete it.


14. Cookies and Tracking Technologies

We use cookies on MarketingBy.AI to operate the website, measure aggregate usage (privacy-respecting analytics), and remember preferences.

We do not use behavioral advertising cookies, cross-site tracking technologies, third-party marketing cookies, or Google Analytics.

You can disable cookies in your browser settings. We honor Do Not Track signals and the Global Privacy Control (GPC).


15. International Users

Marketing By AI operates from the United States. If you access MarketingBy.AI from outside the United States, your information will be transferred to and processed in the United States.


16. Changes to This Policy

We may update this Privacy Policy from time to time. When we do, we will update the "Last Updated" date at the top and post the updated policy at MarketingBy.AI/privacy. For material changes, we will attempt to notify affected individuals at least 30 days before the change takes effect.
